Prosecutors Seek Aggravated Sentence For Rochester Murder Suspect

Rochester, MN (KROC-AM News) - Olmsted County prosecutors have filed notice of their intent to seek an aggravated sentence for the most recent murder to occur in Rochester.

A motion recently filed in Olmsted County Court by the Olmsted County Attorney's Office says, if convicted, a sentence longer called for by state guidelines would be warranted because of Derrick Days past history of violent crimes. The court filing indicates 28-year-old South St. Paul man was convicted of a Crime Committed for Benefit of a Gang in 2015 and being a Felon in Possession of a Firearm in 2016.

Days is charged with three counts of second-degree murder and one count of illegal possession of a firearm stemming from the June 6th shooting death of 28-year-old Todd Banks Jr. at the entrance to a city parking ramp on 1st Avenue Southwest where the men were engaged in a game of street dice.. A second man was critically wounded in the shooting.

Another man, 22-year-old Nautica Cox of Minneapolis is charged with aiding and abetting second-degree murder and a weapons charge for his alleged involvement in the shooting.

Days is next scheduled to appear in court on September 21st for an evidentiary hearing. Cox is due back in court next Tuesday.
